Why do you need a European Authorised Representative?

As the UK left the single market on the 1st January 2021, manufacturers who were selling through a distributor into the EU must have an EU-based Importer or alternative representation. The Government is advising that their distributor becomes their importer however, if this is not possible or desirable, they can appoint someone else to carry out the Importer obligations for them.

Regulation (EU) 2019/1020 came into force on the 16th July 2021 and requires one of the following economic operators – Importer, Authorised Representative (AR) or Fulfilment service provider – to be located in the EU and their details presented with the product.

The Regulation makes it illegal to place certain products on the EU market unless a responsible EU-based economic operator is established. Manufacturers that currently sell, or offer to sell, directly to end users (both professional and consumer) in the EU, without an EU-based economic operator being involved, must appoint one before placing further products on the EU market.

How will our EU Representative Services help you?

Authorised Representative Service will act as your responsible economic operator and carry out the following obligations for you:

  • We will verify that your EU Declaration of Conformity (or Incorporation, Performance, etc.) and technical documentation has been drawn up correctly.
  • We will keep these documents at the disposal of market surveillance authorities for the period required by that legislation and ensure that the technical documentation can be made available to those authorities upon request.
  • Upon request from a market surveillance authority, we will ensure that the technical documentation can be made available to them in order to demonstrate the conformity of the product.
  • If we have reason to believe that a product presents a risk, we will highlight this information to the necessary parties.
  • If a risk is identified, we will liaise with you and support you in taking immediate, necessary, corrective action to remedy any noncompliance causing the risk.
  • As your Authorised Representative, we will provide you with our name and contact details, for you to place on the product, it’s packaging or accompanying documentation.

EU Representative Service FAQ’s

Do I need a separate Authorised Representative contract for each individual product I sell in the EU?

It depends on your product range. We have a number of services on offer that cover:

  • An single product or piece of equipment sold once.
  • An single product type sold regularly.
  • A product family covered by a single technical file.
  • A wider product range with multiple technical files
If we sell into the UK and the EU do we need two names and addresses on the product (a UK and an EU one)?

Yes, It is required to have both a EU and UK address on your product if you’re planning to sell your products in both the UK and EU.

We manufacture and assemble electrical products in the UK. We self certify all our products and have a technical file etc. We sell some products in the EU, but only directly to the end user. Can we continue to do that without any EU representation if selling directly to the end customer and not via a dealer or importer?

No, you must appoint an authorised representative if you plan on selling your products in the EU. If you don’t comply, you could be asked to recall your products.

Our company works on the basis of dealerships. We have dealers across the EU. What happens if we do not appoint an Authorised Representative?

If you do not specifically appoint an Authorised Representative then your dealers will each have to take responsibility for the products they sell as if they were the importer.

This means they will have to mark the machines with their name and address and act as the contact point in the event of a market surveillance action. You will need to supply them with copies of your declarations, and also a copy of the technical file if it is requested.
